This issue presents diverse topics. The first article provides guidance to all parties involved in aircraft sales, leasing and financing transactions. Article 1 explains the basic steps of how to sign up for and use the International Registry (IR) under the new Cape Town Treaty. The second article affects everyone who uses off-balance sheet financing, especially in operating lease transactions. Article 2 focuses attention on FASB’s process to change FAS 13 to limit off-balance sheet leasing. BLN Case & Comment describes a 2005 judicial decision about the "sparing" use of "substantive consolidation" of debtor entities in bankruptcy, citing the Owens Corning case. Finally, Leasing 101 defines a "letter of intent" or "LOI" and describes how and when to use one.
